These Terms of Service ("Terms") govern your access to and use of Yun (the "App"), provided by Treelet ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
Your use of the App is also subject to the Apple Media Services Terms and Conditions and the Apple App Store terms that apply to your download and use of the App.
Yun is a camera application for compatible Apple devices that provides features including, without limitation:
We may add, modify, or remove features at any time. Some features depend on your device hardware, iOS version, and granted permissions, and may not be available on all devices.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.
You agree not to:
You retain all rights to photos, Live Photos, and other content you create using the App ("Your Content"). You are solely responsible for Your Content and for obtaining any permissions needed to photograph people, private property, or other subjects.
We do not claim ownership of Your Content. Except as described in our Privacy Policy, we do not access, collect, or store Your Content on our servers as part of normal App operation.
You are responsible for backing up Your Content. We are not responsible for loss of photos or data due to device failure, accidental deletion, or other causes outside our control.
The App requires certain device permissions to function. Camera access is required for core features. Photo library access is required to save captures. Location access is optional and used only for watermark place names when you enable that feature.
You may manage permissions in iOS Settings. Denying required permissions may limit or prevent use of corresponding features.
The App, including its software, design, logos, filters, algorithms, documentation, and all related intellectual property, is owned by Treelet or its licensors and is protected by applicable copyright, trademark, and other laws.
Except for the limited license granted in these Terms, no rights are transferred to you. "Yun" and related marks are trademarks of Treelet. You may not use our trademarks without prior written permission.
Our Privacy Policy explains how we handle information when you use the App. By using the App, you consent to our privacy practices as described therein.
The App runs on Apple platforms and may interact with Apple services (such as the photo library, Live Photos, and location services). Your use of those services is governed by Apple's terms and privacy policies.
We are not responsible for third-party services, websites, or content that you access outside the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PHOTOS WILL MEET YOUR EXPECTATIONS. SMART CAPTURE, FILTERS, RETOUCHING, AND OTHER FEATURES ARE ASSISTIVE TOOLS AND MAY PRODUCE IMPERFECT RESULTS DEPENDING ON LIGHTING, SUBJECT, DEVICE, AND OTHER CONDITIONS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREELET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $10.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Treelet and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the App, (b) Your Content, or (c) your violation of these Terms or applicable law.
These Terms remain in effect while you use the App. You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles, except where mandatory local consumer protection laws require otherwise.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If not resolved within thirty (30) days, the dispute shall be submitted to the competent people's court in the jurisdiction where Treelet is located, unless applicable law grants you the right to bring proceedings in your country of residence.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may be communicated through the App or App Store listing where appropriate. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
